Rubio found guilty of capital murder

This afternoon, an Hidalgo county jury found John Allen Rubio guilty of capital murder for the beheading of his three children.

The jury started their deliberations shortly after 11 am and returned with their decision at 3:30 p.M.

Fox 2 cameras rolled as state district judge Noe Gonzalez read Rubios sentence of guilty on all counts. This is Rubio’s second conviction in the case. He was originally sentenced to death, but the conviction was overturned on appeal. The re-trial started two weeks ago.
Testimony for the defense last week suggested that Rubio was mentally ill, believing himself as the chosen one and killing the children because they were possessed.

Meanwhile a psychiatrist testified Friday that Rubio knew the difference between right and wrong when he murdered his children. Angela Camacho, the mother of the three children was also accused in the murders, however she pleaded guilty in 2005 and is currently serving three life sentences.The sentencing phase is underway and will resume tomorrow at 9am. Prosecutors are seeking the death penalty but jurors could decide to sentence him to life in prison.
