Brownsville Mayor Pat Ahumada is scheduled to be tried on three felony charges after a check scandal, but he says he shouldn’t be tried for them all at the same time.
The mayors defense claimss that the theft charge should be severed from the other two charges: abuse of official capacity and misapplication of fiduciary property. They argue a joint trial would require inconsistent defenses.
The reset pretrial hearing has been rescheduled for 10a.m. Oct. 12 in the 107th district court.
Jury selection is scheduled to take place the same day.
The mayor has pleaded not guilty to charges that arose from close to a $30,000 check, dated Oct. 22, that the city issued to city vendor. The check was deposited in ahumadas business bank account.
