In the death of her 2-year-old nephew, the accused 800-pound woman will not face the death penalty.
Hidalgo county district attorney says because of Mayra Rosales’ weight, it would be sufficient for a jury not to believe she could be a danger to others.
“I don’t believe there is evidence in my possession or that we can bring to court at this time where we would think she would be a danger to other human beings.”
Capital murder has two penalties. Life in prison without parole or death penalty. And under state law, the death of a child under the age of six is considered capital murder.
For now, Rosales remains under house arrest and her hearing has been postponed until Monday.
Meanwhile, the boy’s mother, Jamie Lee Rosales, is also charged with injury to a child in the case.
