B.P. Agent Found Not Guilty of Rape

A Border Patrol Agent accused of sexually assaulting a 39-year-old illegal immigrant in October of 2007 was found not guilty. Jurors deliberated close to two hours this afternoon after four days of testimony and cleared 34-year-old Alberto Garcia of rape. Several state’s witnesses testified that on the night of October 24 of 2007, Garcia abused his position to detain and intimidate the alleged victim into having sex with him against her will.
The presiding judge in this was Israel Ramon junior from the 430th district court in Hidalgo County. Garcia has been suspended and is expected to return back to his post shortly.
