ACLU sues Hidalgo County

The American civil liberties union of Texas has filed a class action law suit against Hidalgo county, specifically pointing out the sheriff and all 9 justices of peace. It challenges officials in Hidalgo county on how teenagers are being jailed in an adult detention center for skipping school and not paying truancy fines.

According to the union, the routine practices in Hidalgo county are unconstitutional and create a “school to prison pipeline.” about 150 teens have served time under similar circumstances since January of 2009.

Hidalgo county executive officer, Valde Guerra released the following statement on behalf of the county:

“Hidalgo county has been made aware of the class action lawsuit allegedly filed in federal court by the American civil liberties union; however; Hidalgo county has not yet been properly serves as of this time. It is the county’s standing practice to refrain from making any comments regarding pending or potential litigation. The county’s and other parties’ responses to this lawsuit will be made to the federal court in accordance with the law”

the ACLU added stated that they found anecdotal evidence from other counties in Texas of students or even parents being jailed for unpaid truancy fines, however nothing came close to the amount of people being jailed for it in Hidalgo county
