Federal Agents Release Hundreds Of Felons To Reduce Costs

Lucille Roybal-Allard, (D-CA)
In a statement Tuesday, immigration and customs enforcement claims potential budget cuts mandated by the sequester prompted the release of some 300 inmates in Arizona alone on Saturday and perhaps more later.
“As ICE made clear, the agency released low risk detainees to ensure detention levels stayed within budget.” Jay Carney, white house press secretary.
ICE currently holds some 30,000 criminal non citizens in prisons around the country, 4,000 *fewer*than mandated by congress. Latino advocates long criticized jail detention as inhumane, and pressured the agency to develop alternatives. In a letter today, congressman McCaul asked ice where and how many detainees it planned to release, along with their criminal records. “The detainees in question are not dangerous criminals. They pose no risk to society.” says Allard. Cops say otherwise. “Theft, burglary, robbery, aggravated assault,” Paul Babeu, Arizona sheriff. Arizona sheriff Paul Babeu says the inmates released into his county are anything but non violent. He fears many will reoffend and disappear. “This idea of supervised release is laughable these are multiple border crossers – they couldn’t stop them at the an international border how on earth are they going to provide supervised release and supervision over these criminals,” Babeu says. ICE claims the detainees while free – are not supposed to leave and must promise to show up in court. Some are required to call in and others may wear an ankle bracelet. Paul Babeau, sheriff of Pinal County, said in an interview, “These are aliens with felony convictions, who have been released into my county.”
“These people should have been released a long time ago,” said Sarah Lanius, a spokeswoman for No More Deaths, a non-profit group in Tucson that runs free legal clinics for illegal immigrants. “They were stopped in silly traffic cases or other situations, and they have no business being put through all this.” Lindsay Marshall, executive director of a group called the Florence Immigrant and Refugee Rights Project, echoed this opinion.
So, what’s the truth?
An ICE spokeswoman in Phoenix said in a statement that the releases were carried out because of “fiscal uncertainty” over budget cuts and … that “priority for detention remains on serious criminal offenders who pose a significant threat to public safety.”
That certainly makes sense and is most likely the way this went down. Leave it to FOX to come up with a completely misleading headline:

It is one thing to have an opinion and another thing to get your facts wrong.
“ICE currently holds some 30,000 criminal non citizens in prisons around the country.” – This is factually and legally inaccurate. People in immigration detention are not serving time for a crime. They are being held in civil immigration detention, and these individuals include asylum seekers and victims of sex trafficking with no prior criminal convictions.
Violating an immigration law is NOT a crime–U.S. Immigration and Customs Enforcement (ICE) has the authority to detain people in what is supposed to be a civil immigration system. Many of these people in immigration detention don’t even have past criminal records. Although the system is supposed to be civil, ICE contracts with county jails and for-profit prisons to hold people. As they are not in criminal custody, people in immigration detention (many of whom are applying for asylum or are actually victims of sex trafficking) have no right to a court appointed attorney. 84% have to represent themselves before an immigration judge. There also is no time limit for how long a person can be held in immigration detention. Human Rights Watch found people in immigration detention with no past criminal convictions for 10 years!
